of ‘the Erika’ in which the French Court handed down judgment on issues
of liability and compensation ordering oil-giant Total to pay a hefty
fine for the sinking of the vessel off the French Coast.
In yet another high-profile pollution case, a contrasting decision was handed down recently concerning the Prestige fiasco.

| training standards for estate agents loom |
It
seems are the days when everyone and his friend could become an estate
agent – out for the easy pickings in a booming property market – are
gone. Apart from the downturn in the market, Government has now stepped
up the regulations relating to training standards and continuing professional
development of estate agents.

In
the recent case of Seperi v Scanlan, the applicant wished
to be awarded damages for breach of promise to marry. She claimed that
she was entitled to half of the husband-to-be's estate (equating to over
a R1 000 000), as the intended marriage was to be in community of
property. She further claimed R250 000 in delict for insult.
On the other side of the coin the defendant (the hubby) alleged
that the beautiful bride-to-be owed him R50 000 for defamation and a
further R140 000 in arrear rental for not vacating his property after
the engagement ended.

| who wants an iphone 2.0? |
We all want an iPhone 2.0, right? But then, you have that pesky contract with your mobile operator which locks you in until 2020 (or so it feels, especially when the latest and greatest hits the shelves). At this stage the speculation mill is hard at work and dates of 11 July, to 20 July to “end-July” is being bandied about. If you are burning to get your hands on the new iPhone 2.0, help might be on hand (no, I didn’t mean that pun!)…. The Independent Communications Authority of South Africa (ICASA) recently released the latest regulations pertaining handset subsidies, just in time for you to sign up for a shiny new iPhone 2.0.

| mobster's moll wins right to practice law|
An Australian lawyer has won the right to continue to practice law despite having a criminal conviction, being linked to the country's most wanted man and facing further criminal charges.
The state of Victoria had refused to renew Zarah Garde-Wilson's licence to practice in 2006 after she was convicted of contempt of court. She was convicted after refusing to testify against the two men who were later convicted of killing her then boyfriend, murderer Lewis Caine. She also faced charges of possessing an unregistered hand-gun and of giving false evidence. However, an appeal court has ruled that she can challenge the decision in the supreme court and continue to practice in the meantime.
Garde-Wilson became something of a celebrity after representing, and allegedly being romantically involved with, Australia's most wanted man, mafia boss Tony Mokbel. She also made it into FHM's list of sexiest women and then gave an interview to GQ in which she described talking to the ghost of her ex-boyfriend and, errr, keeping a vial of his sperm on ice.
Other clients of Garde-Wilson include mobster Carl Williams, also know as the smiling assassin, who was jailed in May for the murder of three "business rivals".
The story of Melbourne's underworld wars has been made into a hit TV show, which should please Garde-Wilson. Unfortunately, she won't be seeing it for a while, as the state of Victoria has issued a court order banning the programme.
