Well, winter is rolling up (although it doesn't always feel like that in the cape yet...), being time to invest in the winter woolies, pack away the shorts and wrap up warmly. Speaking of wrapping up, this is the final edition of the dwp eNewsletter for "this year", next month we'll bump up to volume 2! How the time flies...

 

This edition is one day early since we will all also be off to enjoy the long weekend tomorrow. If you are also going away, be safe and enjoy!

Die Regterlike Dienskommissiewetsontwerp. Val nie goed op die oor nie, maar weet verseker, dit val nog slegter op ’n regter se oor. Hierdie wetsontwerp is nou al vir ‘n geruime tyd in die wetgewende pyplyn, maar het onlangs baie meer aandag getrek.  Vanuit die hele saga rondom die beweerde onetiese optrede van die Hoofregter van die Kaapse Regbank, Regter John Hlope, het dit duidelik geblyk dat daar ‘n groot leemte is met betrekking tot die verantwoording deur regters vir hulle dade en gedrag.

Most people have heard the story of how Macdonald’s was successfully sued after a patron spilt hot coffee on themselves. Stella Liebeck was the successful litigant.

 

Stella become an American icon. For more than 10 years now, the term "Stella Award" has been used to refer to any lawsuit that sounds outrageous and Stella Awards are given annually for the most ridiculous law suits.

Whoever said that one had to be a member of the mafia or the cia in order to dabble in stashing cash inside equipment to avoid detection, clandestine rendezvous, secret codes and pass phrases, certainly didn’t pay the USA pay-tv industry close enough attention!

 

One would be able to excuse the Californian judge reading papers filed in the case of EchoStar versus NDS for thinking he is reading a spy novel, since that is exactly what it sounds like!

 

In essence, NDS, partly owned by Rupert Murdoch’s News Corporation group, was the manufacturer of smartcards for an American pay-tv company, who found themselves in a spot of bother when the smartcards were hacked and distributed over the internet, leaving the pay-tv company feeling like the SABC, with the nightmare of thousands of pirate viewers. Without a not-so-clever “it’s the right thing to do campaign”, the pay-tv company was forced to replace all their clients’ smartcards at a cost of several million dollars.

It seems that despite the credit crunch, lawyers at Nabarro are still looking for ways to get out of doing any work. The following email was circulated around the office, proving that what was a good idea at school is still a good idea at the office...

Subject: Fire Alarm Activation

 

All,

 

Today's fire alarm activation was caused by the use of an aerosol spray (deodorant/hairspray etc.) in one of our toilets. The building fire alarm detection system detects sudden fluctuations in temperature as well as increases in detectable particles (whatever their origin) in the air.

 

Therefore, please do not use aerosol or sprays of any kind in the building as these will cause the fire alarm to activate.
