Winds of change are sweeping across dwp-land during this festive season. Read all about our change in name to wwp later on in this newsletter.
As is the custom, this is our last enewsletter of the year. Our next enewsletter will only be sent out in February, when everybody is back after the upcoming resting period. wwp will be closed for a couple of days, from 21 December to 4 January 2010.

As
from 1 December DWP will change its name to WWP or, to
be more precise, Ward Ward & Pienaar.
It’s a brand new era and, with the name change comes a new look and and also a few new faces! As from 1 March 2010 a new partner, Angelique Heerink, will be joining our team. Angelique presently practices as an advocate and she specialises in MVA claims and alternative dispute resolution. Her specialised skills will expand the existing spectrum of services already offered by the firm.
Although the name change also spells an end of an era, we know that WWP will become a household name in the legal field. We will continue to offer the trusted levels of service that our clients are accustomed to. Yet, we have to change with the times, so as to continue our striving to be the best at what we do.
It was John F Kennedy who said that: “Change is the law of life. And those who look only to the past or present are certain to miss the future”

| texas marriage mess |
Four
years ago, Texas enacted legislation which some may argue, has done away
with the institution of marriage. The offending paragraph reads,
“Marriage in this state shall consist only of the union of one man and
one woman. This state or a political subdivision of this state may not
create or recognise any legal status identical to or similar to
marriage.”
The legislation was originally enacted to ensure that no form of gay marriage/ union would be recognised in the state of Texas. Radnofsky, a Democratic candidate for attorney general argues that the amendment has the potential to affect the status of all marriages in the state of Texas, “You do not have to have a fancy law degree to read this and understand what it plainly says.” The parties responsible for the drafting of the legislation have ignored the criticisms and stand by the amendment.

| obligations of estate agents after ending a mandate |
The
matter of Move on up 254 (Pty) Ltd v Martin Kruger Associates CC,
which was heard in the Western Cape High Court in November this year,
discussed the principle issue of whether an agent
is under an obligation to provide information to his principal, upon the
termination of his mandate. It was decided, as shall be seen, that such
an obligation does exist.

Daar
is tans ‘n vrystelling op die betaling van hereregte in sekere gevalle
waar ‘n woning oorgedra word van ‘n maatskapy of trust na die inidividu
of individue wie se woning dit was en wie die belang in die maatskappy
of trust gehou het.
Die vrystelling is van toepsaasing op die toepaslike vervreemdings (verkopings of skenkings) vanaf 11 Februarie tot 31 Desember 2011. Indien hereregte per ongeluk betaal is op ‘n transaksie waarop die vrystelling betrekking sou wees, kan diesulke hereregte teruggeeis word deur die normale proses vir terugbetalings te volg.
Alhoewel die vrystelling reeds in effek is het SARS egter steeds nie die proses of die nodige dokumente gefinaliseer om met hierdie vrystellingsaansoeke te handel nie.

A
word of warning goes out to landowners who lease their property – it is
necessary in the eyes of the law to be aware of what happens on your
land.
In the case on Mazibuko v National Director of Public Prosecutions (2009, SCA) Mr and Mrs Mazibuko (the appellants) jointly owned a farm which they sub-let to an individual who they believed used the farm to manufacture fertilizer and graze his cattle.

As
the year end approaches, Swindon Property are starting to see a strong

the recessionary environment looks to be drawing to a close. According
to the economist with a 0.9% GDP increase the positive incline is
directly related to a bolstering in the manufacturing industry and the
positivity around 2010. This manufacturing upswing can be seen directly
in our industrial brokering division with a large letting surge over the
last 3 months going into the new year.
With the rise in GDP and the four large banks loosening their lending criteria together with the positive surge of the World Cup 2010 ,Swindon are excited at what the new year holds for them and their clients. | judge pulls a sickey to play computer games |
He made the claim in an interview with The Times newspaper, which reported that Will Statton (not his real name) is a 48-year-old "district judge at a county court in England".
Judge Statton's secret shame is apparently a craving for violent computer games, and when CoD:MW2 went on sale he queued outside his local HMV from 11pm, waiting for the doors to open at midnight. "Like Charlie waiting outside the chocolate factory", as he put it.
The judge then spent the night gunning down innocent civilians, before "feigning sickness to get out of his commitments despite the chaos that would inevitably follow".
The article also contained the following additional clues to his identity: he is married, has two children, was a barrister for 15 years, and really should grow up a bit.
