Administration of Estates Act amendment

In terms of the Administration of Estates Act, 1965, the terms mentally ill person or person with severe or profound intellectual disability will replace the reference to ‘lunatic’.

| changing the way jurisdiction is founded |

 

High Courts only have jurisdiction over matters when the nature of the claim falls within the statutory jurisdiction of the High Court specifically and when the amount of a claim exceeds the value of R100 000,00. The specific High Court jurisdiction will depend upon where the cause of action (that which brought about the dispute, i.e. where the contract was signed, there the negligence occurred etc.) arose or whether the defendant resides within the proximity of that particular High Court. Furthermore the High Court only has jurisdiction over citizens of South Africa unless jurisdiction is established and founded in a High Court with regards to a foreign person or entity.

In 1966, in the small town of Napier, a constable Liebenberg arrested the accused for being drunk in public. The accused was eventually convicted of being drunk in public, resisting arrest, escaping from custody, and the theft of a pair of handcuffs. The matter went on review as the question arose whether the accused had the requisite intention to steal a pair of handcuffs. The court set out the facts as below.

| bogus lawyer faces 25 years in jail |

 

A man who worked as a lawyer for ten years - despite never having even attended law school - was convicted of fraud this week.

 

54-year-old Howard Kieffer set up an office in California back in the nineties, and was paid hundreds of thousands of dollars to handle appeals in at least ten states. He hosted an internet discussion forum on sentencing issues and spoke at several seminars. Kieffer was only caught when one of his clients, who had paid him fees of $37,000, wrote to a judge to ask whether he had ever qualified.

 

A North Dakota jury took under two hours to convict Kieffer on Wednesday. He now faces up to 25 years in jail, a fine of up to $500,000 and the prospect of being prosecuted in several other states.
